Terms of Service

These Terms of Service (the "Terms") govern the use of the Evokly platform (the "Service", "Evokly", "we", "our") available at evokly.io.
By accessing and using Evokly you accept these Terms in full. If you do not accept them, please do not use the Service.
1. Purpose
Evokly is a platform for collecting, organising and sharing event photos and videos. The Service lets event organisers create dedicated spaces where attendees can upload and browse media, with advanced features such as face matching.
2. Acceptance of the Terms
Using the Service means accepting these Terms in full. They apply to every user, whether visitor, attendee or event organiser.
We may change these Terms at any time. Changes take effect as soon as they are published. It is your responsibility to review these Terms regularly.
3. Description of the Service
Evokly offers the following features:
- Creating and managing events
- Uploading and storing photos and videos
- A shared gallery with access control
- Face matching to find photos
- Media download
- Managing access and visibility permissions
We may modify, suspend or discontinue all or part of the Service at any time, with or without notice.
4. Registration and user account
4.1. Creating an account
To use certain features you must create an account with accurate, complete and current information. You undertake to keep that information up to date.
4.2. Account security
You are responsible for keeping your login and password confidential. You undertake to:
- Not share your credentials
- Use a strong, unique password
- Tell us immediately about any unauthorised access
- Sign out after each session on a shared computer
4.3. Responsibility
Any activity carried out from your account is presumed to have been carried out by you. You are responsible for every action taken under your account.
5. Using the Service
5.1. Permitted use
You undertake to use the Service lawfully and in accordance with applicable law.
5.2. Prohibited uses
It is strictly forbidden to:
- Upload illegal, defamatory, obscene, pornographic or offensive content
- Infringe someone else's intellectual property rights
- Upload viruses, malware or any malicious code
- Attempt to gain unauthorised access to the Service or its systems
- Use the Service for unauthorised commercial purposes
- Harass, threaten or invade the privacy of others
- Impersonate another person or entity
- Collect other users' data without authorisation
5.3. User content
You retain full ownership of and all rights in the photos and videos you upload. By uploading content you grant us only a non-exclusive, limited and royalty-free licence to host, store, process and display that content for the sole purpose of providing you with the Service (organising, presenting and sharing media within your event, face matching where consent is given, technical backups). That licence ends when the content is deleted or when the event's storage period expires.
You warrant that you hold every right needed over the content you upload and that it infringes no one else's rights.
5.4. No commercial exploitation of your media
The photos and videos you store on our servers will NEVER be used for commercial purposes. We do not sell them, pass them to third parties, use them for advertising or marketing, or use them to train artificial-intelligence models. Your media exists solely to run the Service for you, your event and your guests. The licence granted in clause 5.3 covers no other use.
6. Intellectual property
The Service — including but not limited to its design, logos, text, graphics, icons and source code — is the exclusive property of Evokly and is protected by French and international intellectual property law.
Reproducing, displaying, modifying, publishing or adapting all or part of the Service is strictly forbidden without Evokly's prior written permission.
7. Prices and payment
7.1. Plans
Evokly offers several subscription plans. Prices are shown in euros including tax and may change at any time. Price changes do not apply to subscriptions already running.
7.2. Payment
Payment is made by card or any other accepted payment method. Payment is due immediately for monthly subscriptions, or on order for per-event payments.
7.3. Invoicing
An electronic invoice is generated automatically and sent to the email address linked to your account.
7.4. Refunds
Under applicable law you have a 14-day right of withdrawal from the date you subscribe, except for services fully performed with your express agreement. Per-event payments are not refundable once the event has been created.
7.5. Access period and ending a subscription
The features of the subscription plans (Pro, Agency, Enterprise) — in particular white-label, face matching, HD download, event quotas and extended storage — require an active subscription.
One-off purchases (Event, Event Pro) keep the storage period set at the time of purchase (6 months), regardless of any subscription.
If a subscription is cancelled or not renewed, then at the end of the period already paid for, events created during the subscription automatically revert to the Event plan: photo storage is reduced to 6 months from the end of the subscription (never extending an earlier deadline), preceded by a 14-day grace period. New events then fall under the free plan. To keep an event beyond 6 months you can resubscribe to a subscription plan (storage up to 12 months).
On subscription plans, an event's date cannot be set more than 12 months after it is created.
8. Liability and warranties
8.1. Availability of the Service
We aim to keep the Service available 24/7 but cannot guarantee uninterrupted availability. The Service may be temporarily unavailable for maintenance, updates or in the event of force majeure.
8.2. Limitation of liability
To the extent permitted by law, Evokly cannot be held liable for:
- Indirect damages, loss of data or loss of profits
- Interruptions to the Service
- Content uploaded by users
- Use of the Service that does not comply with these Terms
8.3. Force majeure
Evokly cannot be held liable in the event of force majeure or events beyond its control.
9. Protection of personal data
The processing of your personal data is governed by our Privacy Policy, which complies with the GDPR. By using the Service you accept that policy.
10. Termination
10.1. Termination by the user
You can close your account at any time from your account settings or by contacting us. Termination takes effect immediately. No refund will be made for the current period unless the law requires otherwise.
10.2. Termination by Evokly
We may suspend or close your account in the event of:
- Breach of these Terms
- Fraudulent use of the Service
- Non-payment
- Extended inactivity (more than 2 years)
10.3. Consequences of termination
On termination, your access to the Service is suspended immediately. You may request an export of your data within 30 days. After that, your data may be deleted in line with our retention policy.
11. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and failing an amicable settlement, the dispute will be brought before the competent French courts.
Under article L.612-1 of the French Consumer Code, you may use a consumer mediator free of charge to settle a dispute with us amicably. For more information: www.economie.gouv.fr/mediation-conso.
